Official Rules and Regulations
These Official Rules & Regulations govern the conduct of the 2020 Pebble Beach Golf Raffle (hereinafter “Raffle”) and, together with the decisions of THE MAP FOUNDATION, INC (hereinafter “MAP Foundation”), are binding on everyone who purchases a Raffle ticket and/or who is named on a Raffle ticket. The Raffle is a fundraising activity conducted by MAP Foundation in support of the WOODHILL COMMUNITY CENTER and other youth-focused causes. These Official Rules & Regulations may not be waived, modified or supplemented unless such waiver, modification or supplementation is made in writing by MAP Foundation.
Grand Prize Drawing
The Grand Prize drawing for the Raffle will be held on Monday, September 28, 2020, at 4:00 PM Eastern, on Facebook Live, except this date and all other dates stated in these rules may be extended at the absolute discretion of MAP Foundation. In the event the Raffle is postponed, all reasonable efforts will be made to notify ticket holders of the new drawing date. On-line ticket orders must be received before 12:00 Noon Eastern Monday, September 28, 2020. Tickets may sell out before that time. The drawing will be conducted under the supervision of MAP Foundation. The winning ticket will be drawn at random from a drum containing all eligible Raffle tickets. The drawing will be held on Facebook Live and viewable by the public, and there will not be a gathering of people incident to the drawing of the Raffle winner during the State of Emergency.
The price per ticket is $100.00. Employees, Directors, and Officers of The MAP Foundation, Inc., are not eligible to participate.
The Raffle winner will receive a twosome in the annual Lexus Champions For Charity National Championship at Pebble Beach Resorts, December 9-13, 2020, including 2 rooms and $1,000 cash allowance for air fare or incidental expenses. In the event the Lexus Champions For Charity National Championship is cancelled for any reason and Lexus Champions For Charity does not offer the winner the opportunity to play in the 2021 National Championship, the winner will receive a $12,500 cash prize in full substitution therefor.
MAP Foundation does not undertake to give advice on the legal or tax consequences of the Raffle or its winner. However, it understands that the IRS position is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and, consequently, do not qualify as deductible charitable contributions.
By participating in this Raffle, all ticket purchasers and the person named on each Raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by MAP Foundation for publicity purposes and naming of the Grand Prize winner to be published in area newspapers or other media including television, radio, web and print. The Grand Prize winner will be published on Lexus of Lexington and Woodhill Community Center websites. The name of the winner may be obtained by sending a written request plus a self-addressed, stamped envelope to The MAP Foundation, Inc., 1999 Richmond Road, Suite 300, Lexington, KY 40502. MAP Foundation’s interpretation and application of the rules and regulations shall be final.
By participating in this Raffle, each participant releases MAP Foundation, Lexus of Lexington, Lexus and Woodhill Community Center and each of their respective members, directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind, including, but not limited to, liability for injuries, losses, or damages arising from or caused by any prize or resulting from acceptance, possession, use or misuse of any prize; and each winner agrees to indemnify and hold MAP Foundation, Lexus of Lexington, Lexus and Woodhill Community Center and each of their respective members, directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize.
The Raffle is open to the general public, and ticket purchasers and the person named on the Raffle ticket must be at least 18 years of age at the time of purchase. The Grand Prize winner may be required to sign an affidavit of eligibility. Employees, Directors and Officers of The MAP Foundation, Inc., are not eligible to participate. Offer void where prohibited by law.
In order for the Grand Prize winner to receive their prize (subject to the other provisions in these rules), the Grand Prize winner must elect to receive the prize by delivering written notice of that election to MAP Foundation, by October 28, 2020. MAP Foundation shall notify the winner by certified mail within seven (7) days of the drawing that the winner shall claim the prize within thirty (30) days.
If a winner does not wish to claim the prize but wishes to donate it to MAP Foundation for the benefit of Woodhill Community Center and other youth-focused causes, the winner shall provide MAP Foundation with a written statement within the thirty (30) day period stating that the winner wishes to donate the prize to MAP Foundation for the benefit of Woodhill Community Center. A prize winner shall not donate the prize back to MAP Foundation if to do so would violate KRS 238.540(7).
If the Grand Prize winner does not claim the prize or donate it to MAP Foundation within thirty (30) days after having been contacted, MAP Foundation shall notify the Department of Charitable Gaming and draw another ticket in the presence of Department personnel. The tickets shall remain under the control of MAP Foundation until another Grand Prize winner is identified and accepts the prize.
All Raffle ticket sales are final. No other refunds are available. MAP Foundation assumes no responsibility for any failure to receive orders prior to the drawing deadlines. A Raffle participant’s sole and exclusive remedy for MAP Foundation’s breach shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall MAP Foundation, Lexus of Lexington, Lexus, Woodhill Community Center or their respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
Tickets are $100.00 each; and until further notice or directives from Governor Andy Beshear with regard to Executive Order 2020-215 that declared a State of Emergency in the Commonwealth of Kentucky due to the outbreak of the COVID-19 virus, Raffle tickets may be purchased exclusively online from MAP Foundation at the following website: www.mapfoundationraffle.com.
At such time, if any, as the State of Emergency is no longer in effect, tickets will continue to be available for purchase on-line but will also be available for purchase in person solely from MAP Foundation, Lexus of Lexington, Woodhill Community Center or their agents.
You may buy as many tickets as you wish, subject to availability, until a maximum of 1,250 tickets are sold. Each Raffle ticket will be entered separately in the drawing. Each Raffle ticket is a separate and equal chance to win the Grand Prize.
At such time as the State of Emergency is no longer in effect, tickets may be purchased by mail using a ticket request form obtained by calling 1.859.233.2000, X 8944, or by sending a SASE to MAP Foundation, 1999 Richmond Road, Suite 300, Lexington, KY 40502. Ticket requests must include payment or credit card information to be eligible; and completed forms must be sent with payment or credit card information to MAP Foundation, 2020 Pebble Beach Golf Raffle, 1999 Richmond Road, Suite 300, Lexington, KY 40502. To request tickets by fax, send the form to 859.233.5922. For credit card payments, your ticket number(s) will be sent to you by email or US mail; and the ticket stubs will be completed with your contact information and placed in the drawing container. In the event the State of Emergency is no longer in effect and fax requests are permitted, fax requests must be received before 5:00 PM Eastern on Friday, September 25, 2020. All sales are final. If the credit card transaction is denied for any reason or your check does not clear the bank, no ticket shall be sold, and the ticket purchase request is null and void. The purchaser will be notified immediately of the problem, and the next ticket order in line will be processed.
When a Raffle ticket order is placed and funds have cleared, MAP Foundation will complete the Raffle ticket for the purchaser by filling in the name, address, email and phone number of the purchaser. MAP Foundation will then place each completed Raffle ticket stub in a secured location at the offices of MAP Foundation in Lexington, Kentucky, and email or mail the ticket(s) to the purchaser. Whenever possible, the purchaser will receive an email from MAP Foundation confirming the ticket purchase and providing the ticket number(s).
Ticket And Payment Verification
MAP Foundation reserves the right to reject any ticket request form that is submitted with payment that does not constitute “good funds.” All defective or physically altered request forms are subject to disqualification at the discretion of MAP Foundation. Prior to the Grand Prize drawing, MAP Foundation will make a reasonable effort to notify any individual who submits such an entry form, or one which has been rejected because the credit card or check did not clear, that the entry has been rejected. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline.
Grand Prize Winner
Winner notification will be made by telephone, email, US mail and posted on the web page. The winner will need to provide proper identification to the satisfaction of MAP Foundation. A representative of MAP Foundation will assist in coordinating all the details with the winner regarding the Grand Prize. Winner agrees to the use of his/her name, photograph or videotape likeness and statements for publicity purposes by MAP Foundation, Lexus of Lexington, Lexus and Woodhill Community Center and agrees to sign a publicity release without any further compensation.
The Grand Prize winner assumes and must pay all income taxes, local, state and federal taxes associated with the value of the prize won. MAP Foundation assumes no responsibility for a prizewinner’s tax obligations. The Grand Prize winner will be required to pay federal and state tax withholdings for the fair market value of the Grand Prize to MAP Foundation before the Grand Prize will be released to the Grand Prize winner. The Grand Prize winner is strongly advised to seek professional legal or tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner, including, without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. Forms W-2G & 941 will be filed with the Internal Revenue Service to report the value of the prize won. The Grand Prize winner will also receive a copy of these forms. This offer is void where prohibited by law; and all federal, state and local laws and regulations apply.
Prize Awards In Event Of Non-Sellout Of Tickets
A maximum of 1,250 tickets will be sold. If fewer than 1,250 Raffle tickets are sold, MAP Foundation reserves the right, in its absolute discretion, to postpone the date of the drawing until a date that is within seven (7) days from the date on which 1,250 tickets have been sold. MAP Foundation reserves the right to cancel this Raffle contest at any time, in which event liability is limited to the refund of the ticket price to all participants.
Registration With The State Of Kentucky
This Raffle for the benefit of WOODHILL COMMUNITY CENTER and other youth-focused causes is conducted by The MAP Foundation, Inc., and licensed by the Department of Charitable Gaming, License Number ORG 0002332.
